Josh Mandel or Mike Gibbons for U.S. Senate ?

This blog previously reported on two candidates for the U.S. Senate, Jane Timken and Josh Mandel – to replace retiring RINO Rob Portman.  Both campaigns are attempting to run on President Trump’s coat-tails.  This was the envelope containing the first solicitation from Mandel's campaign a month or two ago:

Apparently the Mandel campaign has now backed off, as Mr. Trump’s name does not appear in his most recent solicitation, which our household received last week. But instead of having Trump’s name (and implied endorsement) on the envelope, look at what’s at the top of his letterhead:

"America First" appears prominently --  twice -- on President Trump’s office website
here

Some Ohio liberty groups are endorsing Mandel. Cleveland Tea Party traditionally does not state a preference until after the primary, but prior to the primary, we would not support Mr. Mandel’s candidacy; see also here. We’re still looking at Mike Gibbons.

How about Mike Gibbons

Rob Portman is not running for re-election in the U.S. Senate. Cleveland Tea Party's Ralph King posts:

Let the swamp games will begin!

We need a good guy like Mike Gibbons at the top of the list to run for this seat -- not an establishment swamp retread like Slickster Jim Renacci or Ohio's Happy Hypocrite Jon Husted running for this seat.

More about Mr. Gibbons here

Catching up on last week’s news: Mike Gibbons running for U.S. Senate

map image credit: cleveland.com

Last week, Jeremy Pelzer at cleveland.com reported (h/t Ralph King):

COLUMBUS, Ohio--U.S. Senate candidate Mike Gibbons was endorsed by the Franklin County Republican Party on Wednesday by an overwhelming margin, giving the Cleveland-area businessman a high-profile win in his underdog bid to snatch the GOP nomination from Treasurer Josh Mandel.
The county party's central committee vote was 85-16, according to Gibbons. It's the first time Gibbons has been endorsed by a county party; the Cuyahoga County GOP previously endorsed Mandel.

Senator Rob Portman MIA while Cruz & Senate Conservatives Oppose Amnesty by Executive Order

Senator Ted Cruz has sent a letter to lame duck Senate Majority Leader Harry Reid opposing President Obama's threat of using an Executive Order granting amnesty to illegal immigrants to again undermine the power of Congress.

Joining in with Senator Cruz in standing strong against President Obama continued abuse of his Executive Powers are Sens. Mike Crapo, R-ID; Mike Lee, R-UT; Pat Roberts, R-KS; Jeff Sessions, R-AL; and David Vitter, R-LA.

And in contrast, reminding us what spineless looks like, Senator John McCain has taken to pleading with President Obama not to use an Executive Order for granting amnesty to illegals.

Being from Ohio, when speaking of spineless on illegal immigration - having been a keynote speaker at a pro-amnesty event last year, Senator Rob Portman leads the jelly fish jubilee.

Though his voting record shows he would be a better nominee for the Democrats than the GOP, it is being widely reported that Senator Portman, instead of running to keep his U.S. Senate seat, has not ruled out running to be the GOP nominee for the White House in 2016.

When you stop laughing about Portman looking to run as the GOP nominee for POTUS, please contact his office and tell him - if he is looking to be reelected to anything -- now would be the time to at least act like a conservative and sign onto the letter from Senator Cruz.

From Senator Ted Cruz --

Don’t Enable Obama’s Executive Amnesty in Lame Duck

GOP SENATORS SEND WARNING TO HARRY REID AFTER RESOUNDING REFERENDUM

November 5, 2014

202-228-7561

WASHINGTON, DC - Sen. Ted Cruz, R-Texas, today sent a letter to Sen. Harry Reid, D-NV, the outgoing Senate Majority Leader, signed by Sens. Mike Crapo, R-ID; Mike Lee, R-UT; Pat Roberts, R-KS; Jeff Sessions, R-AL; and David Vitter, R-LA expressing opposition to President Obama's announced intention to take unilateral executive action by the end of this year to lawlessly grant amnesty to immigrants who have entered the country illegally.

"The Supreme Court has recognized that ‘over no conceivable subject is the power of Congress more complete' than its power over immigration," the letter said. "Therefore, President Obama will be exercising powers properly belonging to Congress if he makes good on his threat. This will create a constitutional crisis that demands action by Congress to restore the separation of powers."

The letter continued: "As majority leader of the Senate, you have the responsibility of not only representing the citizens of your State, but also of protecting the Constitution through vigilant exercise of the checks and balances provided under the Constitution. Therefore, we write to offer our full assistance in ensuring expeditious Senate debate and passage for a measure that preserves the power of Congress by blocking any action the President may take to violate the Constitution and unilaterally grant amnesty; however, should you decline to defend the Senate and the Constitution from executive overreach, the undersigned Senators will use all procedural means necessary to return the Senate's focus during the lame duck session to resolving the constitutional crisis created by President Obama's lawless amnesty."

The text of the letter is below:

November 5, 2014

Senator Harry Reid
Majority Leader
S-221, The Capitol
Washington, D.C. 20510

Dear Leader Reid:

We write to express our alarm with President Obama's announced intention to take unilateral executive action by the end of this year to lawlessly grant amnesty to immigrants who have entered the country illegally. The Supreme Court has recognized that "over no conceivable subject is the power of Congress more complete" than its power over immigration. Therefore, President Obama will be exercising powers properly belonging to Congress if he makes good on his threat. This will create a constitutional crisis that demands action by Congress to restore the separation of powers.

As majority leader of the Senate, you have the responsibility of not only representing the citizens of your State, but also of protecting the Constitution through vigilant exercise of the checks and balances provided under the Constitution. Therefore, we write to offer our full assistance in ensuring expeditious Senate debate and passage for a measure that preserves the power of Congress by blocking any action the President may take to violate the Constitution and unilaterally grant amnesty; however, should you decline to defend the Senate and the Constitution from executive overreach, the undersigned Senators will use all procedural means necessary to return the Senate's focus during the lame duck session to resolving the constitutional crisis created by President Obama's lawless amnesty.

Sincerely,

###

Statement by Senators McCain, Graham, Rubio & Flake on Senate Leader Harry Reid's Comments on Immigration Reform

You know the border crisis is serious when you have three of the GOP Senate members known for being weak on illegal immigration, Senator McCain, Senator Lindsey Graham and Senator Marco Rubio speaking out against it.

But they say nothing about trying to stop President Obama's threat to wield his magic pen and issue an Executive Order Amnesty for the border jumpers illegally entering our country.

And notably missing from the growing chorus of "convenent conservatives" speaking out against Obama's border BS is Ohio's own Senator Rob "I Love Illegals too" Portman.

From Senator John McCain --
Washington, D.C. – U.S. Senators John McCain (R-AZ), Lindsey Graham (R-SC), Marco Rubio (R-FL), and Jeff Flake (R-AZ) today issued the following statement on Majority Leader Harry Reid’s comments today regarding legislation to address the humanitarian crisis on the border:

“Last year, we voted to pass immigration reform legislation through the United States Senate. While we continue to support the goals of comprehensive immigration reform, none of us would support – or have ever contemplated – including that bill or the DREAM Act in legislation urgently needed this year to address the current humanitarian crisis on our southern border. It is obvious that Majority Leader Reid’s suggestion that the Senate could include comprehensive immigration reform in its border crisis bill is a blatant attempt to scuttle House Republicans’ good-faith efforts to pass legislation addressing the issue this week.

To be clear: Without our support – which he would not have – it would be impossible for Leader Reid to add comprehensive immigration reform or the DREAM Act to any border crisis bill this week. We encourage our colleagues in the House to move forward and pass legislation focused exclusively on addressing the current humanitarian crisis on the border, and finally test whether Democrats will work constructively with Republicans to solve this humanitarian crisis on our border, or play politics with an issue of urgent national importance.”

Is Senator Rob Portman really "Against" Obamacare?

In light of the John Kerry like flip-flops we have seen from Senator Portman lately, a fair question to ask would be is, "is Senator Rob Portman 'really' against Obamacare and is he dedicated to defunding it?"

In fairness to Senator Portman, it should be noted that he has signed on as a co-sponsor of a bill to defund Obamacare and also joined in with all 46 Republican Senators in a letter urging President Obama to permanently delay the implementation of Obamacare.

But, as we have so painfully seen, just because Senator Portman say's he is against something, doesn't mean he is "really" against it.

Highlighting just some of  Senator Portman's recent triple lindy flips off the high dive of conservatism and belly flopping into the pool of progressive politics, we see Senator Portman....
  • Was once strongly against same sex marriage -- he now supports same sex marriage.
  • Continually claimed he was against Richard Cordray being appointed to lead the Consumer Financial Protection Bureau -- he voted in support of Cordray's confirmation.
  • Continually claimed he was against the Senate Immigration Reform bill (S. 744) -- he voted in support of Cloture which allowed the bill to move forward and eventually pass.
Well thanks to Senator Mike Lee (R-UT), Senator Portman has an opportunity to do the right thing and show conservatives where he stands by reinforcing his claims of being "against" Obamacare.

Senator Mike Lee (R-UT) and 14 of his fellow Senate Republicans sent a letter to Senate Majority Leader Reid (D-NV) urging him to delay all of Obamacare, and declaring their intent to defund the law in any Continuing Resolutions or other measures to fund the federal government.

So, with Senator Portman co-sponsoring a bill to defund Obamacare, his joining with fellow Senators urging the permanent delay of Obamacare and, being fully aware that voters in Ohio have soundly rejected Obamacare with passage of the Ohio Health Care Freedom Amendment, one would think it would be a no-brainer that Senator Portman would support Senator Mike Lee's letter and additional attempts to defund Obamacare -- right?  Wrong!

To date, even though he claims to be against Obamacare, Senator Portman has not signed onto Senator Lee's letter to defund Obamacare in Continuing Resolution talks. Taking into account the above items Senator Portman also claimed to be against, his not supporting this effort should be a cause of great concern.

If we are to defeat or defund Obamacare - the do or die fight is now and Senator Portman needs to decide and show us whose side he is on.

Please contact Senator Portman's office and urge him for once to keep his word and not abandon his conservative base again.  Please urge Senator Portman to sign Senator Lee's letter and support this do or die effort to defund Obamacare.

Food Stamp Give Away to Illegal Immigrants Must be Stopped!

Already not having enough money to continue funding a signature program of Obamacare, medical coverage for pre-existing conditions, President Obama's Department of Agriculture is actively promoting and funding a program for illegal immigrants to get food stamps.

In pushing healthy American citizens to the back of the bus and forcing us to pay to feed illegal immigrants while many Americans still go hungry, President Obama also sends a message to those Americans with pre-existing medical conditions that he would rather feed illegal immigrants over treating their health issues as he promised....

From The Washington Examiner --

With food stamp spending in the United States skyrocketing since the beginning of the recession, the Department of Agriculture is paying to promote food stamp usage to illegal immigrants for the sake of their American children, according to documents obtained by a government watchdog.

“The promotion of the food stamp program, now known as “SNAP” (Supplemental Nutrition Assistance Program), includes a Spanish-language flyer provided to the Mexican Embassy by the USDA with a statement advising Mexicans in the U.S. that they do not need to declare their immigration status in order to receive financial assistance,” Judicial Watch announced today.

“Emphasized in bold and underlined, the statement reads, ‘You need not divulge information regarding your immigration status in seeking this benefit for your children.’

Under President Obama's watch food stamp benefits have increased more than double each year. In addition, with the removing of a 1996 requirement that individuals receiving SNAP must have a job or be enrolled in work training and lowering the bar for SNAP eligibility - people receiving food stamps has increased to an all time high of 47.8 million people.

To find out how many people in your county are on food stamps, click here.

Senator John Thune (R-SD) and Rep. Marlin Stutzman (R-Ind.) have introduced a bill, "Streamlining the Supplemental Nutrition Assistance Program (SSNAP) Act" in attempts to stop this foolishness and reign in the rampant fraud, waste and abuse of an already out of control food stamp program....

The food stamp program may be cut when Congress moves to pass a farm bill this year. Sen. John Thune, R-S.D., and Rep. Marlin Stutzman, R-Ind., introduced a bill last week to cut $30 billion from the $760 billion the program is expected to spend over the next ten years.

“Since President Obama came into office, SNAP participation has increased at 10 times the rate of job creation, the annual spending on SNAP has doubled, and one in seven Americans now participates in SNAP,” Thune said in a statement on the bill. “This explosive growth in both the SNAP enrollment and federal cost of the program is alarming and requires lawmakers to take cost-effective legislative control measures.”

“We save taxpayers $30 billion and make sure that families in need still receive a helping hand,” Stutzman added. “This is a common-sense start for Congress’ Farm Bill discussions as we look for ways to tackle Washington’s nearly $17 trillion debt.”

This common sense bill will also protect and help assure that Americans that really do need these benefits will still receive them.

This is important as the Obama Administration's progressive policies have clearly shown their repeated willingness to push Americans to the back of the bus. Most notably, it is the elderly, sick, less fortunate and low-income Americans - that Obama claims to protect - that most often suffer the undue hardships of these policies.

Please contact your Senator and Congressman and ask them to support Senator Thune and Rep. Stutzman's "Streamlining the Supplemental Nutrition Assistance Program (SSNAP) Act".

Senator Rand Paul; A Duty to Preserve the 2nd Amendment

From The Washington Times --

When Congress reconvenes next month, Senate Majority Leader Harry Reid is expected to bring gun control back to the Senate floor. If this occurs, I will oppose any legislation that undermines Americans’ constitutional right to bear arms or their ability to exercise this right without being subject to government surveillance.

Restricting Americans’ ability to purchase firearms readily and freely will do nothing to stop national tragedies such as those that happened in Newtown, Conn., and in Aurora, Colo. It will do much to give criminals and potential killers an unfair advantage by hampering law-abiding citizens’ ability to defend themselves and their families. Potentially on the table are new laws that would outlaw firearms and magazines that hold more than just a handful of rounds, as well as require universal “background checks,” which amount to gun registration. We are also being told that the “assault weapons” ban originally introduced by Sen. Dianne Feinstein is not happening. We can only hope. But in Washington, D.C., bad ideas often have a strange way of coming up again.

These laws are designed to sound reasonable, but statistics have shown that gun control simply does not work. What constitutes reasonable? If limiting rounds and increasing surveillance were really the solution to curbing gun violence, why should we stop there? Because everyone knows that none of this actually curbs gun violence.

Gun control itself is unreasonable.Chicago has some of the toughest gun laws in the entire country — and one of the worst gun-crime rates, with more than 500 homicides last year. Compare this to Virginia, where in the past six years, gun sales went up by 73 percent, while violent gun crime fell 24 percent. The types of firearms and clips the left is currently so intent on banning are used in fewer than 2 percent of gun crimes — and how many of those crimes involve registered weapons? Few to none.

For every national tragedy that happens, there are hundreds if not thousands of examples of Americans preventing similar killings from happening, thanks to the use of personal firearms. Last June, for example, a 14-year-old Phoenix boy shot an armed intruder who broke into his home while he was baby-sitting his three younger siblings. The children were home alone on a Saturday afternoon when an unrecognized woman rang their doorbell. After the 14-year-old boy refused to open the door, he heard a loud bang, which indicated that someone was trying to break into the house. The boy hurried his younger siblings upstairs and collected a handgun from his parents’ room. When the boy rounded the top of the stairs, there was a man standing in the doorway with a gun pointed at him. The boy shot at the intruder and saved the lives of his three younger siblings.

There have been would-be mass murderers who have walked into schools, churches, shopping malls, movie theaters and other public places who didn’t get very far because, thankfully, an armed citizen was nearby. There have been countless home invasions, armed robberies and other assaults in which lives were saved, thanks to citizens possessing private firearms. These stories are heroic, but they don’t become big headlines. We should all be glad that they don’t become such headlines, thanks to the unsung heroes who prevent them from becoming potential national tragedies.

For these reasons, I will oppose any attempt by President Obama, Mr. Reid or anyone else in Washington who works against Americans’ right to bear arms. Sens. Mike Lee and Ted Cruz have decided to join in this effort. We do this not only because it is right — but because it is our duty as United States senators.

When I stood up for the Fourth and Fifth Amendments during a filibuster a few weeks ago to address drones and executive power, it was not because I was partial to those amendments, important as they are. When I came into office, I took an oath to uphold the Bill of Rights.

I took an oath to uphold the First Amendment. I took an oath to uphold the Second Amendment.

The Second Amendment reads: “The right of the people to keep and bear arms shall not be infringed.” It doesn’t say “might be” infringed. Nor does it say “could be” infringed. It read “shall not” be infringed. The current gun-control legislation being proposed unquestionably infringes. For these reasons, I will work diligently to stop any such gun-control legislation. Our Constitution, individual liberty and personal safety depend on it.

Sen. Rand Paul, Kentucky Republican, is a member of the Senate Foreign Relations and Homeland Security committees.

Stop Online Sales Tax -- Call Your Senator Today!

Looking for anyway to continue squeezing a penny from the American citizens and businesses in order to continue their out of control spending, the U.S. Senate is again considering an online sales tax in their budget talks....

From The Daily Caller --
Lawmakers are again trying to attach an online sales tax to larger legislation they consider more likely to pass.

The Marketplace Fairness Act, which would allow states to levy sales taxes on goods purchased online, is being proposed as an amendment to the Senate budget for fiscal year 2014 by bill cosponsors Wyoming Republican Sen. Mike Enzi and Illinois Democratic Sen. Dick Durbin.

In the last session of Congress, the bill was proposed as an amendment to the National Defense Authorization Act, but the move failed.

Though many lawmakers initially signed on to this year’s version of the Marketplace Fairness Act, including many Republicans, momentum for the bill has slowed.

There has been talk that the bill may be added to a larger comprehensive tax reform bill, though some feel that the measure should remain a separate bill.

The Senate budget proposal — the first unveiled in the upper chamber since 2009 — is expected to be debated through the week.

Call your U.S. Senator and tell them to vote NO on The Marketplace Fairness Act!

Assault Weapons Ban "Shot Down" in the Senate

Like a clay pigeon at a Trap-Shooting Range, Senator Harry Reid shot down Senator Dianne Feinstein's proposed assault weapons and high-capacity magazine ban.

Due to a lack of support in the Democrat-controlled U.S. Senate, Reid pulled Feinstein's anti-gun proposals from the main bill, but said he would allow them to be offered up as separate amendments.....

From The Hill --
Senate Majority Leader Harry Reid (D-Nev.) has decided the federal assault weapons ban will not be a part of the base bill and warned Tuesday an expansion of background checks to cover private sales might not make the cut, either.

Instead, a bipartisan measure cracking down on straw purchasing and illegal trafficking of firearms will serve as the foundation of firearms legislation.

That is a significant blow to Obama, who recently touted that the Senate Judiciary Committee had advanced “three of the most important elements of my proposal to help reduce the epidemic of gun violence in this country.”

Obama’s three pillars have been reduced to one, with the bill facing an uncertain future in the GOP-led House.

Reid said the assault weapons ban sponsored by Sen. Dianne Feinstein (D-Calif.), which faces staunch opposition from the gun rights group, could have sunk the entire legislative effort.

Reid told Feinstein that he would give her a vote on the assault weapons ban, which includes curbs on high-capacity clips, and a second vote on a stand-alone amendment to ban high-capacity bullet magazines.
In response to Reid pulling her assault weapons and magazine ban from the Gun Bill, Feinstein, having less than 40 votes in support of her proposals, cackled back...
“This is very important to me and I’m not gong to lay down and play dead,” she said on CNN. “I think the American people have said in every single public poll that they support this kind of legislation.”

“If it’s an amendment, it’s not a symbolic vote,” she said. “I did the bill in 1994 on the floor as an amendment. It was enacted there, it went on the House, and it was enacted there.”
Having far less than enough support, Feinstein's anti 2nd Amendment proposals will most likely be shot down again when offered up as amendments.

And, if for some reason the gun bill passes out of the Senate with Feinstein's amendments, as long as the GOP members in the GOP-controlled House remember they are conservative and supposed to support our 2nd Amendment rights, and as long as Speaker John Boehner is not having another "I Love Obama" moment, there should be no chance of it passing out of the House like it did in 1994.

Big Brother Alert: Police Want Wireless Providers to Save Your Text Messages

From Mashable --

The same day that Google is asking Congress to strengthen privacy protections for Americans' emails, the cops are arguing that U.S. law should require cellphone providers to store text messages logs in the event authorities need to read them in the course of a criminal investigation.

According to the proposal, backed by a coalition of law-enforcement associations, wireless companies like AT&T, Verizon, Sprint and T-Mobile would have to record and store customer's text messages for at least two years, as first reported by CNET last year.
Richard Littlehale, a supervisor with the Tennessee Bureau of Investigation, testified this morning in front of the House Subcommittee on Crime, Terrorism, Homeland Security and Investigations, echoing the law-enforcement coalition's proposal. In his prepared remarks (PDF), Littlehale lamented that the cellphone companies don't retain text messages, a practice that "can hinder law enforcement investigations."
"Billions of texts are sent every day, and some surely contain key evidence about criminal activity," he said. "In some cases, this means that critical evidence is lost." And that's why he thinks cops should have a chance to go to cellphone providers and get their hands on old text messages if they need to, "with appropriate legal process, for at least some period of time."
According to the Electronic Frontier Foundation, which was live-tweeting the hearing this morning, Littlehale said he would like carriers to keep the information for one year.
Nowadays, data retention policies vary from carrier to carrier and there's no uniform law mandating the companies to store information for a determined amount of time. Companies don't publicize their data retention policies, but throughout the years, activists' and reporters have been able to piece together some scattered information.
In 2011, through a Freedom of Information Act request, the American Civil Liberties Union obtained an internal Justice Department memo showing that as of 2010, AT&T, T-Mobile and Sprint didn't store the contents of text messages, while Verizon kept them for just 3 to 5 days, and Virgin Mobile for 90 days.
In 2011, Anonymous gained access to the Gmail account of a retired supervisor of the San Diego-based multi-agency Computer and Technology Crime Hightech Response Team. In an email received by the retired supervisor Alfredo Baclagan, and sent by Baltimore detective Rich Peacock, the latter discusses providers' data retention policies, confirming Verizon's and AT&T's policy and revealing differences with the rest. "Sprint stores their text message content going back 12 days and Nextel content for 7 days. [...] Us Cellular: 3-5 days Boost Mobile LLC: 7 days," reads the email, published on Wired's blog Threat Level.
In his conclusion, Littlehale emphasized the importance of giving law enforcement access to information that can help track down criminals, as well as the importance of balancing that with people's privacy interests.
"Just as there is no question that people have an interest in preserving the privacy of that information," he said. "There can be no question that some of that information holds the keys to finding an abducted child, apprehending a dangerous fugitive, or preventing a terrorist attack."
