Prager U. VS YouTube [Updated]

Last week, John Hinderaker at PowerLine had an update on Prager U’s legal battles against YouTube’s and Google’s censorship of its educational videos:

For several years, YouTube has suppressed Prager U’s videos by “restricting” them, which makes them invisible to viewers who are using the restricted mode, as is the case in many school environments, and by not allowing them to be monetized. After multiple appeals of YouTube’s discriminatory decisions, Prager U sued YouTube and Google in federal court, alleging violations of the First Amendment and the Lanham Act (the federal law that governs advertising in interstate commerce), as well as several causes of action under California law. The district court judge granted defendants’ motion to dismiss the federal counts, and Prager U appealed. That appeal was argued on Tuesday before a three-judge panel of the 9th Circuit Court of Appeals.

That YouTube has engaged in viewpoint discrimination to the detriment of Prager U is indisputable. That YouTube does this because its employees disapprove of conservatism is obvious. But YouTube and Google are private companies, and the First Amendment applies only to government. (“Congress shall make no law…”) The U.S. Supreme Court has articulated a narrow exception where the First Amendment can apply to private entities if they “exercise powers traditionally exclusively reserved to the State.” Prager U faces an obvious hurdle, in that hosting videos is not a traditional governmental function.

Mr. Hinderaker is not all that optimistic in a speedy remedy:

Prager U may yet win its case, which is in its early innings. Perhaps the 9th Circuit will hold that Prager’s First Amendment and Lanham Act claims state a claim, and give it a green light to pursue discovery. Perhaps Prager U will prevail on its state law causes of action, although I assume that California’s judiciary is securely in the hands of the Democratic Party, which generally is not in favor of free speech. But for the foreseeable future, the Left’s control over the principal means of public communication will remain a huge advantage.

:Michelle Malkin is on Google’s Blacklist

Thank goodness the Big Tech giant hasn’t taken over the newspaper syndication business yet. Twenty years of column writing have allowed me to break news and disseminate my opinions without the tyranny of social justice algorithms downgrading or whitewashing my words.

But given the toxic metastasis of social media in every aspect of our lives, especially for those who make their living exercising the First Amendment, it may only be a matter of time before this column somehow falls prey to the Google Ministry of Truth, too.

Indeed, my first substantiated censorship by Google/YouTube, which was covered by The New York Times, occurred 13 years ago in 2006. Around that time, it also became clear to me that humans, not algorithms, were manipulating Google Images to prioritize unspeakably crude photoshopped images of me disseminated by left-wing misogynists. And not long after, my heavily trafficked blog posts started dropping off the search engine radar altogether.

Big Tech is hiding behind the law: update

President Trump convened a summit of social media giants, including Facebook and Twitter. Following the summit, President Trump announced:

“Today, I am directing my administration to explore all regulatory and legislative solutions to protect free speech and the free speech rights of all Americans,” POTUS Trump announced. “We hope to see transparency, more accountability, and more freedom.”

J.D. Heyes at NewsTarget further reported:

In 2016, before the tech giants began altering their search, publication, and distribution algorithms, conservative speakers were dominant on social media, likely helping propel the president to victory. But by the 2018 elections, based on several studies and investigative reporting, the tech giants had begun — in concert — campaigns to silence conservative, pro-Trump voices, led by the behemoths Facebook and Twitter.

The companies are taking advantage of Section 230 of the Communications Decency Act of 1996, which “provides immunity from liability for providers and users of an interactive computer service who publish information published by others,” the Minc Legal Resource Center noted.

The Electronic Frontier Foundation added that “Section 230 says that ‘No provider or user of an interactive computer service shall be treated as the publisher or speaker of any information provided by another information content provider.’” 

But, argue opponents, when Facebook, Twitter, Google, YouTube, and other platforms begin censoring content they find politically objectionable, that makes them publishers, and they therefore should lose their immunity to face legal consequences for those acts of censorship, especially if they have taken money from users they are censoring.

The president’s summit may already be having a positive effect on conservative and independent publishers. For instance, The Western Journal, whose Facebook traffic had been reduced significantly, suddenly found its traffic returning to normal levels a day before the summit — after months of battling with the platform to get it restored.

There is a long way to go, however, to ensure that all conservative and indy publishers’ traffic from their subscribers and followers returns to normal. The president has at least gotten the ball rolling, and well ahead of the 2020 elections.

Well, good. It's a start.

Steve Wozniak’s advice for Facebook users

Should First Amendment rights be extended to Big Tech corporations to publish and censor as they please?  This is a question that has agitated the discussion on whether antitrust legislation should be applied to infogiants such as Google, YouTube, Twitter, Facebook, Reddit, Amazon, Pinterest and many others that have cornered the market on a public resource, information, and an essential human activity, the consumption of information. A solution to the problem of data sequestration and restricted access practiced by these companies is to rebadge them either as publishers or, alternatively, as public utilities.

Apple co-founder Steve Wozniak has some advice for most Facebook users: Delete your account.

The millionaire, who co-founded Apple with Steve Jobs, recently said that a lack of privacy is his main concern regarding the Menlo Park, Calif. company and Big Tech in general.

“There are many different kinds of people, and some [of] the benefits of Facebook are worth the loss of privacy,” Wozniak told TMZ, which spoke with the tech mogul at Reagan National Airport in D.C. “But to many like myself, my recommendation is – to most people – you should figure out a way to get off Facebook.”

Wozniak deleted his Facebook account back in March 2018, shortly after news broke about the Cambridge Analytica data scandal, which revealed that the private data of millions of Facebook users was being harnessed by the firm that worked for Donald Trump's presidential campaign. The United Kingdom's top data watchdog group concluded that Cambridge Analytica's use of Facebook's data was illegal under British law.

Deactivating your Facebook account does not delete your information from Facebook's servers. It's hidden from other users, unavailable to the public, but it continues to live on in Facebook's vast digital-storage vaults. If you're ever interested in revisiting the photos you posted to Facebook way back when, or getting back in touch with that long-lost friend, you may want to deactivate your Facebook page instead of outright deleting it.

YouTube is constantly tweaking and changing their algorithm. Most of the time these changes are small and are barely noticed.

Lately, however, YouTubers large and small have been complaining about how little growth their channels have experienced. Apparently, YouTube’s algorithm has been changed to favor mainstream media outlets like CNN over small, independent content creators.

YouTuber Mark Dice reported on this just the other day.

The result is that YouTubers aren’t seeing their channels grow in the way that they should.

Justin Derby of Truth: The Objective Reality has noticed that YouTube’s latest round of censorship means that many YouTubers are gaining more subscribers on their BitChute channels…and he has the evidence to back it up.

It's no longer just Facebook, Twitter, and Google who are censoring online content that offends political correctness.  Wordpress.com, a blog-hosting site that offers anyone the opportunity to create and publish a blog at no cost, has decided to de-platform — in other words, kill — a blog that has been operating for 15 years: Creeping Sharia.

As Pamela Geller points out, this move by Wordpress.com is itself an example of the blog's focus of creeping sharia happening in real time.  Shutting down a critic of creeping sharia is an example of creeping sharia.

The White House has announced a new system that gives Americans the power to call out foul play by tech companies.  

As of May 15 it read, “SOCIAL MEDIA PLATFORMS should advance FREEDOM OF SPEECH.” 

“Too many Americans have seen their accounts suspended, banned, or fraudulently reported for unclear ‘violations’ of user policies,” it continued before delivering a bipartisan message that freedom of speech is a right held by all Americans. “No matter your views, if you suspect political bias caused such an action to be taken against you, share your story with President Trump.”

The submission form begins with a survey asking users to submit their names and confirm that they are citizens of the United States. It then asks whether they were censored via major Big Tech platforms such as Facebook, Twitter, and YouTube. It also listed an option for “Other” acknowledging that there are plenty of other platforms which deplatform users.

It then asks, if possible, for a link or screenshot of the restricted post. 

In a reversal of Trump’s earlier praise of Twitter as a way to reach his audience free of being filtered by the media, this White House page asked users for permission to send newsletters via email so that the administration “can update you without relying on platforms like Facebook and Twitter.”

The Trump administration said it was “fighting for free speech online,” while the liberal Washington Post characterized the new system as part of Trump’s “war against Facebook, Google and Twitter.”

Mark Steyn on “The Big Shut-Up”

In this week of second-birthday celebrations for The Mark Steyn Club, the thing most worth celebrating is mere existence: We haven't yet been vaporized. Every day the Big Shut-Up advances: Last week Facebook eighty-sixed Alex Jones, Milo Yiannopoulos, Paul Joseph Watson and for good measure Twitter suspended the Hollywood contrarian James Woods. It's a bit unfair on poor old calypso conspiracist Louis Farrakhan, who found himself de-platformed with all the right-wing haters just because Speech Commissar Zuckerberg needed a bipartisan figleaf. He won't require that much longer, and indeed Big Social is growing ever more brazen in its preference for monitored speech over free speech. (See, for example, Google's thuggish and moronic censorship of the Claremont Institute.)

As readers may have noticed, I don't do Facebook posts or Tweet: We have social media accounts but we use them only to link to content here or to promote radio, TV and stage appearances. To be honest, I don't really understand why so-called "conservatives" write (for free) on Facebook and Twitter, providing the Big Social cartel with more free content and thus enriching them and cementing their near total control of the Internet. Nor do I understand why Dennis Prager, for whom I have almost boundless admiration, sued YouTube for giving his Prager University videos insufficient prominence. Conservatives demand that YouTube cease "de-monetizing" their videos. For what it's worth, the first time I was de-monetized on YouTube, I self-de-monetized all my other videos on the platform. Because whatever percentage of ad revenue you might get from them, YouTube takes more - much more. So you're getting pennies while they're getting even more stonkingly mega-rich: Conservatives who think more YouTube revenue is the way to close the gap don't seem to grasp that they're actually widening it.

In the end, the solution to Facebook and Google/YouTube is to break them up before they police every aspect of human existence on the planet. And right now the only prominent politician pledging to do that is ...Elizabeth Warren. In the meantime, in our modest corner of the Internet, our policy is to try and do as much as possible independent of the Big Tech oligarchies - because anything else just accelerates the shrinking number of entities that control access to all information.

A decade ago, we free-speechers were fortunate enough to fight our battles in Canada just before Facebook and Twitter came along and wrecked the Internet. Today, Twitter's main function is to provide a pretext for destroying random lives pour encourager les autres.

These are very dark times for a meaningful culture of free speech. Its subordination to identity politics and political correctness is now taken for granted by the Institute of Directors, Rugby Australia, the Philadelphia Flyers and on and on. In such a world I am grateful still to be here, and I thank all of you who swing by each morning even as the lights flicker and die around a once lively Internet.

Tech Researcher Epstein Warns Conservatives: Get Off Gmail!

I’ve been reading about the thumb-on-the-scale algorithms built into searches and regular activities on Google, Facebook, YouTube, and so on. A tech researcher, Dr Robert Epstein, was a guest on Fox News a couple of weeks ago, so I recognized his name in an article today at Newsbusters. Here’s a sampling:

Google has more power and control than most people realize and a top tech researcher is warning about it.

In an interview at the D.C. premiere of the Creepy Line, a documentary on the dangers of Google and Facebook, Dr. Robert Epstein told the Media Research Center that Google was building personal profiles of users mainly through Gmail. He warned that Google was compiling information upwards of 3 million pages per user, and said, “The more they know about you, the easier it is for them to manipulate you without your awareness.”

Epstein explained what parts of Gmail Google used to create these profiles: every single part.

“I can’t even begin to emphasize how important it is that you not use Gmail. The problem is that it’s so extensive it’s hard to condense into a sentence or two. But the point is that they’re taking that information, not just from the emails you send, but even from the drafts, those crazy drafts that you decide not to send, that all becomes part of your personal profile. If you’re mentioning other people, that goes into their personal profiles.”

He mentioned that it didn’t matter if some users had emails outside of Gmail, those were on the profiles too.

[C]onservatives have “special reasons to be concerned” based on the leaked emails and videos from Google concerning the 2016 election. Detailing an article that he was about to release, he said, “I describe 10 different methods by which Google and big tech companies can shift millions of votes in the midterm elections coming up in the U.S. I estimate upwards of 12 million votes.”

In the Fox interview I watched, Dr Epstein made the point that the compiling of data and the manipulation of YOUR online activities to influence YOUR decisions, including your vote, are taking place and leaving no paper trail. Scary. Read the rest here.

Breitbart has reported on the "the extent to which major technology companies such as Google are surveilling their users." But the segment that I hope everyone will watch (it’s less than 4 minutes) is Dr. Robert Epstein’s appearance on Tucker Carlson from (apparently) a few months ago and re-broadcast last Friday.

Dr. Robert Epstein, a research psychologist at the American Institute of Behavioral Research and Technology, joined Carlson to discuss an upcoming presentation on “The Search Suggestion Effect (SSE): How Search Suggestions Can Be Used To Shift Opinions and Voting Preferences Dramatically.”

The researchers looked at the power of Google and Facebook to influence elections over a period of five years and came up with powerful results.

“I can tell you we should be paranoid because what Google and Facebook can do is really mind-boggling,” he told the host.

“For example, if Mark Zuckerberg on election day last year, if he had chosen to press the enter key early in the morning and just sent out a message to Hillary Clinton supporters only saying, ‘Go out and vote,’ that would have sent her an additional 450,000 voters that day with no one knowing that this had occurred. And that’s just Facebook,” he added.

“What Google can do is really off the scale. Our studies show that Google can take a 50-50 split among undecided voters and change it into a 90-10 split with no one knowing they had been manipulated and without leaving a paper trail,” the research continued.

“It has to do with those search suggestions. Literally from the very first character that you type into the search bar you are being manipulated,” Epstein said. “And we’ve done 16 months of experiments. We’ve done all the research now and we know exactly how this works… The threat is absolutely, positively profound.”

E-Censorship

Most days I visit several news aggregators to find reports, analyses, and commentary. A couple of weeks ago, one of the aggregators, Lucianne.com, was down for several days. It wasn’t the first time it went down, and I wonder about why it happened. For the last two days, another aggregator, Politipage, has gone blank. Hmm. Maybe these were just technical crashes. Both these aggregators lean conservative.

In what are probably related developments, some prominent conservative voices have been demonetized or blocked from Facebook or other platforms. Among them are Diamond and Silk, Pamela Geller, Robert Spencer, and Avi Yemini.

Glenn Reynolds (Mr. Instapundit) has an op-ed in the Wall Street Journal today titled “When Digital Platforms Become Censors: Facebook, Twitter, YouTube and other tech giants say that they’re open forums. What happens when they start to shut down voices they consider beyond the pale?”:

Call 2018 the “Year of Deplatforming.” The internet was once celebrated for allowing fresh new voices to escape the control of gatekeepers. But this year, the internet giants decided to slam the gates on a number of people and ideas they don’t like. If you rely on someone else’s platform to express unpopular ideas, especially ideas on the right, you’re now at risk. This raises troubling questions, not only for free speech but for the future of American politics and media.

The biggest problem with the compromise is that abandons all pretense of fiscal restraint, and virtually guarantees more harmful and irresponsible can-kicking.  The GOP-led Congress has agreed to a two-year plan that will add $1.5 trillion to deficits over a decade, establishing a higher baseline from which "cuts" will be opposed, and on which additional spending will be built.  And Republicans have done so while surrendering a powerful mechanism (reconciliation) that allows them to pass budget policies without requiring the help of tax-and-spend Democrats (as they did on tax reform).

Any time you hear Washington talk about bipartisan agreement, America, grab your wallet and run!

Once again, lawmakers in Washington have finally cut through all the thorny brambles of partisanship and discovered (yet again! yippie!) something they can all agree upon: spending scads and scads more of other people’s money that we don’t even have!

Support for military expenditures was a key talking point for Congress critters like Sean Duffy, who voted "yes." 

It’s still out-of-control spending. And back to Benson:

Here's what bothers me: Republicans didn't even really try.  They could have attempted a full-court press explaining the need for increased military funding, while arguing that in an era of $4 trillion in annual federal spending (up from less than $1.8 trillion in fiscal year 2000, just for some perspective), breaking caps on domestic spending is unnecessary.  Or they could have demanded that in exchange for some heightened domestic spending for discrete priorities, Democrats would have to agree to some modest and mathematically-essential entitlement reforms. 

Instead, we got this [via The Washington Examiner]:

In 2017, for the first time in the post-Tea Party era, Republicans finally gained unified control of government. They spent months blundering on healthcare, and ultimately reneged on their eight-year promise to repeal Obamacare. They have now agreed on a deal with Democrats that would blow up the spending caps that were a legacy of the Tea Party movement — to the tune of $300 billion over the next two years...The agreement would boost military spending by $165 billion above the 2011 caps and nonmilitary spending by $131 billion; it boosts emergency disaster relief spending by $90 billion (remember when the Tea Party Republicans believed emergency spending needed to be offset?); provides $6 billion in more money to fight opioid addiction; has $20 billion in infrastructure funding; it provides more funding for community health centers; and it repeals the Independent Payment Advisory Board, one of Obamacare’s cost-containment initiatives, without any significant alternative ideas to curb Medicare spending. Now, let’s get one thing clear. It's possible to rein in long-term debt while keeping taxes relatively low and military spending relatively high, but only if those policies are met with a dramatic strategy to restrain entitlements and other non-defense spending. But that’s not what Republicans are doing.

I had hoped for better. Reminder to self: the GOPe are members in good standing of the Uniparty.

Falcon Heavy rocket boosters perfect landing

INSANE! SpaceX Falcon Heavy Side Boosters Landing Simultaneously at Kennedy Space Center

Off topic, but just "awesome." The Falcon Heavy SpaceX test launch earlier this week was as astonishing to watch as was Neil Armstrong taking his first step on the Moon. And Elon Musk put a Tesla inside the rocket as payload. Nice touch. 

But it was the booster rockets that disconnected from the main rocket and guided themselves back to earth, hitting their landing pads perfectly - sort of like pencils landing directly on their erasers. The split screens show the booster coming down to Earth feet-first, as it were, and the cameras on the boosters themselves let you watch the landing pads come into focus as the boosters approach their target. I've never seen anything like it.

Recently, Cleveland Tea Party blogged on the cancellation of Pamela Geller’s PayPal account on her blog. There are other blatant examples of attempts to shut down discussions, but I just found this one, from last month:

Those of us who love watching these two gals in their support of all matters Trump should be flabbergasted and aghast. And it’s getting worse. According to the report in the Washington Times, here’s YouTube's chilling explanation:

News of the largely demonetized channel comes less than two weeks since the company announced plans to fight inappropriate content.

“We’ll soon be applying tougher treatment to videos that aren’t illegal but have been flagged by users as potential violations of our policies on hate speech and violent extremism,” the company announced Aug. 1 on its official blog. “If we find that these videos don’t violate our policies but contain controversial religious or supremacist content, they will be placed in a limited state. The videos will remain on YouTube behind an interstitial, won’t be recommended, won’t be monetized, and won’t have key features including comments, suggested videos, and likes.”

"Inappropriate content?" “Our policies on hate speech and violent extremism”? “Controversial religious or supremacist content”? Who is making these judgments?

Enough patrons called and pressured PayPal into reinstating Pamela Geller’s account.

Tech Giants War on Free Speech

Are we losing our First Amendment Rights?

In case you don’t follow Pamela Geller, she specializes in defending the right to free speech and, in particular, threats to free speech presented by jihad and sharia law. Geller is fearless, and she is under perpetual death threats.

Quite recently, subsequent to the Southern Poverty Law Center putting another target on her back, her access to PayPal was withdrawn. Enough readers complained, and PayPal backed down and restored access. Now it’s Google search drives and YouTubes that are limiting her right to free speech. 

If you do not bookmark her website, you might never hear about this. Jihad and sharia law may not be your particular focus, but your right to free speech is probably toward the top of your priority list. It would be for any Tea Party person. We already know that under the previous administration, the weaponized IRS targeted all sorts of conservative and liberty groups. It's getting worse.

Captain Luis Avila salutes his Commander-in-Chief

Many Tea Party people watched President Trump’s tribute to our veterans on the weekend run-up to Independence Day. There was one moment during his speech that I had to re-watch, and it was the part when President Trump paid tribute to US Army Captain Luis Avila and his wife Claudia.

Captain Avila served several tours of duty in Afghanistan and Iraq and lost his leg in an IED attack. This man was not expected to survive. He remains largely paralyzed, he is in a wheelchair, but just watch this short video. He can barely move his body, and yet he struggles mightily to salute, to literally salute, his Commander-in-Chief, President Trump (at about 1:40) and to bow in acknowledgement. It brought tears to my eyes. He is one of many Americans who knows that we have a CiC who loves our country and honors our veterans who defend our way of life.

God Bless US Army Captain Luis Avila, his wife Claudia, and President Donald J. Trump.
