Ohio ILLEGAL immigration watchdog group awards Ohio Rep. Courtney Combs

From Grassroots Rally Team --

FOR IMMEDIATE RELEASE:

Several Founding Members of The Grassroots Rally Team of Ohio, which has been actively combating ILLEGAL immigration in Ohio (www.grassrootsrallyteam.org) since May 2007, traveled to Columbus on Sept 22 to present the first Award of Appreciation from the Rally Team to Ohio State Representative Courtney Combs (R-Oh 54 district, Butler County) for his sponsoring legislation in Ohio that would protect Ohioans from the adverse effects of ILLEGAL immigration.

Of particular note is Ohio HB 184 which Representative Combs sponsored in May of 2009 and would require all Ohio employers to use the E-Verify system to check the legal status of employees. The bill has not moved out of committee since that time, and will expire at the end of this 128th Ohio General Assembly. Representative Combs told the Rally Team that he would be reintroducing this bill in January 2011.

Representative Combs also told the 6 assembled Rally Team members (Below) that he continues to work on legislation for Ohio which will be comparable to the Arizona SB 1070 bill.

Working Illegal Immigrants Outnumber Unemployed Texans

And they say illegal immigrants only take jobs Americans refuse to do.....
Congressman Lamar Smith of Texas, a co-chair of the Reclaim American Jobs Caucus and Ranking Member of the House Judiciary Committee, issued the following statement regarding the findings:

Representative Smith: “Texans should not have to compete with illegal immigrants for scarce jobs. Unfortunately, because the Obama administration refuses to enforce our immigration laws, out of work Texans are suffering. Worksite enforcement efforts have fallen dramatically since President Obama took office—administrative arrests are down 79% from 2008, criminal arrests are down 62%, and convictions are down 70%. That means it is easier for illegal immigrants to keep jobs that rightly belong to U.S. citizens and legal immigrant workers.”

According to the numbers released by the Reclaim American Jobs Caucus, Texas is the only state where the number of illegal immigrants in the workforce exceeds the number of unemployed citizens. But co-chair Smith said that doesn’t mean other states are not affected by illegal immigration.

Smith (R-Texas): “According to the national numbers, out of work Texans are most affected by illegal immigrants in the workforce. But millions of Americans across the nation are still struggling to find work. If the Obama administration would simply enforce the law, we could make millions of jobs available for out of work Americans.”

Representative Myrick (R-NC): “The unemployment rate in North Carolina could be cut almost in half if hard-working American citizens didn’t have to compete for jobs with people here illegally. Breaking the law shouldn’t be rewarded with a job. The Administration needs to get serious about enforcing our immigration laws. By doing so, we could put millions of American citizens back to work.”

Representative Miller (R-Calif.): “Right now, nearly 2.3 million Californians are out of work, and this number does not account for the millions of others who have seen their hours reduced and wages cut during the recession. At the same time, however, nearly 1.8 million illegal immigrants hold jobs in California. This is simply unacceptable. If the Obama administration is serious about getting Americans off of the unemployment rolls, it needs to enforce our nation’s immigration laws to the highest extent, increase worksite enforcement efforts, and make E-Verify permanent. During these tough economic times, hardworking, job-seeking Americans deserve no less.”

The Reclaim American Jobs Caucus is a 40 Member, bipartisan caucus, headed by Representatives Lamar Smith, Sue Myrick and Gary Miller. As the national unemployment rate remains near 10%, the Reclaim American Jobs Caucus works to highlight the link between illegal immigration and record unemployment in the U.S.

The Reclaim American Jobs Caucus compiled the numbers based off of an August 20 report by the Bureau of Labor Statistics and a September 1 study by the Pew Hispanic Center.

Senate Unanimously Passes Bi-Partisan Border Security Bill

Senator Chuck Schumer, unanimously passes a $600 million border-security bill authorizing an additional 1,500 Border Agents to protect our border....

From New Patriot Journal via WSJ --
On Thursday, the chamber approved a $600 million border-security bill in 31 minutes, from opening gavel to final passage. While their colleagues were enjoying a summer recess, Sen. Chuck Schumer flew in from New York and Sen. Ben Cardin drove his Pontiac from Baltimore to represent the entire Senate in its cavernous chamber.

Mr. Schumer delivered the opening (and closing) speech, while Mr. Cardin sat in the presiding official's chair. Mr. Schumer told his fellow Democrat that he hoped the border bill, which provides 1,500 additional border agents, would "clear the path" for talks on revamping the nation's immigration rules.

"I urge my colleagues on both sides of the aisle to join in this important task," he added, looking around at 99 empty seats.

The New York Democrat proposed passing the bill by "unanimous consent," meaning it would become law as long as no one objected. Mr. Cardin asked the empty room if anyone did, and, not surprisingly, response came there none. Just like that, the bill was on its way to the president's desk. More....

I believe this may be the first piece of legislation the Administration has passed with no opposition. Congratulations -- on their first bi-partisan bill!

U.S. Fish & Wildlife Service helps Illegal Immigrants cross border in AZ

The U.S. Fish & Wildlife Service is providing what they call "humanitarian services" for immigrants & OTM's illegally trying to cross the U.S./Mexico border through the Buenos Aires NWR through the use of watering stations....

From U.S. Fish & Wildlife Service --

Humanitarian organizations will be allowed to continue to provide humane water stations on Buenos Aires National Wildlife Refuge in southern Arizona. After a review of the proposed activity by refuge staff it has been determined that placement of water for use by those in need in the desert will help save lives and is compatible with the purpose of the refuge, which is managed by the U.S. Fish and Wildlife Service.

In order to minimize environmental impacts, sites throughout the 118,000-acre refuge will be allowed for placement of stationary, 55-gallon water drums adjacent to roadsides and in already disturbed areas. Since 2001, three such sites have been
allowed on the refuge.

“Our decision to allow water stations on Buenos Aires was based on a thorough review of different approaches to provide water for humanitarian needs and minimize environmental impacts from each of those approaches,” said Benjamin Tuggle, Southwest Regional Director for the Service. “Placement of these water stations is yet another tool being used by the refuge to provide life-saving aid to those in need in a manner consistent with our conservation mission.”

The refuge’s location along the international border with Mexico within the Altar Valley of southern Arizona provides a unique opportunity to protect remnants of a fragile desert ecosystem and to provide refuge for some of the region’s most imperiled species of plants and wildlife. However, in the past eight years, 25 people are known to have died on refuge lands while trying to cross the desert. Read more...

It looks like plants, wildlife and people illegally entering our country are more important than protecting the imperiled residents of AZ!

Federal funds to fight illegal immigration being used to protect illegal immigrants

U.S. Senators Richard Shelby (R-Ala) and David Vitter (R-La.) sent the below letter to Attorney General Eric Holder requesting him to identify states receiving federal funds for fighting illegal immigration and passing these funds onto cities that provide a safe haven for illegal immigrants.

In short, federal funds to be used in fighting against illegal immigration are being given to cities, more commonly known as Sanctuary cities, that are protecting illegal immigrants and possibly terrorists.....

The Honorable Eric Holder
Attorney General
U.S. Department of Justice
950 Pennsylvania Avenue, NW
Washington DC 20530

Dear Mr. Attorney General,

While you have filed suit against the state of Arizona for fighting illegal immigration, it has been brought to our attention that valuable state and local law enforcement dollars used to fight illegal immigration are wastefully being distributed to cities that encourage and provide safe harbor for illegal aliens.

The Department of Justice (DOJ) administers the State Criminal Alien Assistance Program (SCAAP), which provides federal payments to states and localities that incurred correctional officer costs for incarcerating undocumented criminal aliens.

This program is essentially providing room and board for illegal aliens and potential terrorists in Sanctuary Cities. Localities who hypocritically request SCAAP funding are providing sanctuary and safe havens for criminal aliens. Sanctuary Cities bar law enforcement from doing their job of asking the people they come into contact with about their immigration status, thus mandating an evasion of their legal responsibilities to share immigration information with federal authorities. The results are safe havens for illegal aliens and potential terrorists where essentially the
rule of law does not apply in these cities.

The Department of Justice should not be providing law enforcement dollars to cities that provide safe haven to criminal aliens and potential terrorists, as these tax dollars could be used more wisely and efficiently in cities that are legitimately fighting the battle against illegal immigration.

We understand that DOJ does not support SCAAP, as it has not been officially requested by DOJ in the past seven budget requests. SCAAP was airdropped into DOJ’s Fiscal Year 2011 budget request for $330 million by the Office of Management and Budget (OMB), as seen in the official budget pass-back from OMB to DOJ. Since 2000, five states have disproportionately received $2.2 billion of the $2.8 billion (77 percent) in funding this program has received, with some of these states having Sanctuary Cities.

We request that DOJ and the Inspector General immediately identify cities that have sanctuary policies, show sincerity in the fight against illegal immigration, and immediately re-evaluate the process and formula through which SCAAP is administered. The reauthorization of SCAAP is currently pending before Congress so we would appreciate your expedited response so we may better assist you and the Department of Justice in addressing this matter.

Sincerely,

Richard Shelby & David Vitter

Nebraska town may suspend voter-passed immigration crackdown over costs

From the PD --
Faced with expensive legal challenges, officials in the eastern Nebraska town of Fremont are considering suspending a voter-approved ban on hiring or renting property to illegal immigrants until the lawsuits are resolved.

The City Council narrowly rejected the ban in 2008, prompting supporters to gather enough signatures for the ballot measure. The ordinance, which was approved by voters last month, has divided the community. Supporters say it was necessary to make up for what they see as lax federal law enforcement and opponents argue that it could fuel discrimination.

But the council's president, Scott Getzschman, insisted the elected body was concerned about money, not about any lack of support for the ordinance. The City Council is scheduled to vote on suspending the ban on Tuesday night, a day before the city goes to court over the measure.

The city faces lawsuits from the American Civil Liberties Union and the Mexican American Legal Defense & Educational Fund. City officials have estimated that Fremont's costs of implementing the ordinance -- including legal fees, employee overtime and improved computer software -- would average $1 million a year. Golden RINO Award

Once again the curious conservative from Ohio, Senator George Voinovich, turns a deaf ear on the voice of American citizens when it comes to Illegal Immigration.

For these antics, for siding with Senator Sherrod Brown (D-OH), and for refusing to uphold the Constitution regarding the State of Arizona's Sovereign Rights, we hereby bestow upon Senator Voinovich the newly commissioned Cleveland Tea Party Patriots -- "Golden RINO Award"

With a well polished horn, Senator RINOvich, being one of two Republican Senators, voted in support of allowing the use of federal dollars to pay for the Justice Dept's lawsuit against Arizona being allowed to protect their borders....

The Senate voted against Arizona's right to enforce immigration laws, 55-to-43, by allowing Justice Department funds to be used in the lawsuit against the state. The vote prevented a floor vote on Sen. Jim DeMint's (R-S.C.) amendment to the unemployment extension bill making its way through Congress. The amendment would have blocked funding to the Justice Department from being used in its lawsuit against Arizona.

Five Democrats crossed party lines and voted with Republicans and showed their support for Arizona's latest effort to deal with the its large illegal alien population. Senators Blanche Lincoln (D-Ark.), Mark Pryor (D-Ark.), Ben Nelson (D-Neb.), Max Baucus (D-Mont.), and John Tester (D-Mont.) voted in support of Arizona.

Republican Senators George Voinovich (R-Ohio) and Mike Johanns (R-Neb.) voted with the Democratic majority and against Arizona. (Right Side News)

Congratulations Senator RINOvich -- we are looking forward to your retirement... it won't come soon enough!

WH Spokesman Gibbs fumbles question on Immigration

White House spokesman Robert Gibbs gets tongue tied on immigration question....

H/T Gordon Gekko at Taxmanblog

Gibbs sounds like a man without a teleprompter!

The "Selective Powers" Clause

As many of us have now heard, under orders from President Obama, the Justice Dept. is suing AZ over SB 1070 which will allow the state to defend their state borders and enforce their new immigration laws.

The lawsuit against AZ, like the administrations push for "selective" free speech through the DISCLOSE ACT, "selecting" not to lift the Jones Act & save the Gulf, and their "selecting" not to prosecute the open & shut voter intimidation case of the recent club wielding Black Panthers, you will see is just another case of the current administration using the "Selective Powers" clause they believe is in our Constitution....
Since SB 1070 is a virtual clone of existing federal law, Arizona’s sin against THE ONE, has nothing to do with the letter of the law. The Obama Regime isn’t worried that Arizona’s SB 1070 will ‘supercede’ federal law. The Obama Regime has its Colonista knickers in a knot because - unlike Uncle Sam under Vicente Bush and Pancho Obama - Arizona intends to defend our national sovereignty by - GASP - enforcing America’s immigration laws.

It’s ironic that the Obama Regime is so hot and bothered over a new, as yet unimplemented, Arizona law, when law enforcement officials in RHODE ISLAND, have been doing what SB 1070 mandates, FOR YEARS....

[I]n Rhode Island, illegal immigrants face a far greater penalty: deportation.“There are police chiefs throughout New England who hide from the issue . . . and I’m not hiding from it,’’ said Colonel Brendan P. Doherty, the towering commander of the Rhode Island State Police. “I would feel that I’m derelict in my duties to look the other way.’’

From Woonsocket to Westerly, the troopers patrolling the nation’s smallest state are reporting all illegal immigrants they encounter, even on routine stops such as speeding, to US Immigration and Customs Enforcement, known as ICE. (Hot Air)

Why isn’t the Obama Regime suing Rhode Island? I can explain that in two words: BLUE STATE. If the stench of that selective outrage turd isn’t enough to suffocate you, let’s turn our attention to another glaring example: sanctuary cities.

If Uncle Sam really gave a damn about local governments which supercede federal law, they would paint a Justice Department bull’s-eye on sanctuary cities. Unlike SB 1070 which clones federal immigration law, sanctuary city laws do supercede federal immigration law. When will THE ONE nail any/all of them with a lawsuit? Never, because, he’s okey dokey with anyone who refuses to protect our national sovereignty. (H/T PIG)

As for those wondering what the "Selective Powers" clause is and where it is in our Constitution? There is no such clause as their is no such clause or power allowing the federal government or the President to strip individual states of their rights or enforcing laws they "select" not to like or that run counter to their desire of re-writing our Constitution.

How does Ohio Immigration Law Differ from AZ?

The answer -- prior to AZ passing a state law on immigration -- would be not much. Since OH does not have a state law on immigration we would be governed by the federal immigration laws as stated below by the Lake County Sheriff's Office.

You will see other than putting the power of enforcing immigration in the hands of the state, that even though OH does not have an immigration law on the books there is still not much difference between AZ's law and the federal law.

From the News Herald --

With so much attention focused on Arizona's new immigration law, some have asked how it differs from enforcement in Ohio.

Capt. Lonnie Sparkman of the Lake County Sheriff's Office said the laws are not that different because both mirror federal laws.

To be more specific, Ohio does not have a state immigration law. It operates under the federal law. Arizona recently passed a state law that is, in some ways, more stringent.

The Arizona law requires police to determine the immigration status of someone if that person has been stopped, detained or arrested on another crime and if a "reasonable suspicion exists that the person is an alien and is unlawfully present in the United States."

The law also requires that people have immigration papers with them. However, officers can only ask for immigration papers under the previously described conditions.

While Ohio law does not require officers to ask about immigration status, Sparkman said Ohio law officers can inquire about immigration status under the same circumstances.

Originally, the Arizona law said officers had to ask about immigration status if there was reasonable suspicion during any "lawful contact." The law was rephrased after a Phoenix police officer sued, saying that he would need to ask it of children on their way to and from school.

That unrevised law would have differed significantly from Ohio's.

Arizona lawmakers reworded it so people had to be stopped, detained or arrested for another crime before they could be asked of their immigration status.

Lake County Sheriff Daniel Dunlap stressed that his department does not make pretextual stops, meaning that deputies do not pull people over because they think the drivers are in the country illegally.

However, Dunlap said, if a person has been pulled over and they do not have identification, they may inquire as to legal status.

"If there's a traffic offense or a reasonable suspicion of a crime, we will stop you. And what is the first thing that authorities ask for when you're pulled over? Driver's license and registration," Dunlap said.

If the Lake County Sheriff's Office identifies someone as being in the country illegally, it will contact a federal enforcement agency, either Immigration and Customs Enforcement or U.S. Customs and Border Protection.

Dunlap said most people carry some identification with them, and it is rarely an issue.

"It's a pretty low percentage of people who get picked up and don't have papers, much smaller than you'd think," he said.

Justice Dept. to Challenge AZ Immigration Law

This was pretty much expected....

From CBS News --
As Hotsheet reported yesterday, Secretary of State Hillary Clinton said in a television interview in Ecuador this month that the Obama Justice Department "will be bringing a lawsuit" against the controversial Arizona immigration measure signed into law earlier this year.

The comment was striking because both President Obama and Attorney General Eric Holder had said only that the administration was considering a suit. Arizona Gov. Jan Brewer, who signed the law, called Clinton's comments stunning and added that "to learn of this lawsuit through an Ecuadorean interview with the secretary of state is just outrageous." She has said in the past she is prepared for a court fight.

It was unclear yesterday whether Clinton's comments were simply a prediction or mistake or whether instead she was getting ahead of a planned announcement by the administration.

Now a senior administration official tells CBS News that the federal government will indeed formally challenge the law when Justice Department lawyers are finished building the case. The official said Justice is still working on building the case.

Even though the federal government refuses to do their job and enforce the federal immigration laws, they have no problem launching a full-frontal assault on the rule of law in Arizona -- that being the State of AZ Constitution.

It because of these types of over-reaching, unconstitutional, state sovereignty smashing & complete disregard for the rule of law tactics we see coming out of D.C. that the citizens in the State of OH must prepare and arm ourselves with lawful measures protecting our state sovereignty.

By helping the People's Constitution Coalition of OH (PCCOH)
get the State Sovereignty Amendment to the OH Constitution on the ballot you can help protect the rights afforded to us as citizens in the State of Ohio and hopefully stop the onslaught of unconstitutional authorization, legislation and regulation being mandated & passed by this administration.

Go to the PCCOH website (click here) & sign up to sign or help circulate petitions.

We are also encouraging member to ask their local City Council or Township Trustee's to pass a resolution in support of Arizona's new immigration law. For a copy of the Resolution Supporting AZ's Immigration Law click here.

Challenge Your City to Stand FOR Arizona

Patriots,

Now is your chance to fight back for Arizona!

Under the pressure of pro-amnesty groups more and more cities are coming out against AZ's new Immigration -- we need to help them fight back against these full-frontal assaults on their rights as a sovereign state of this great nation.

With the City of Cleveland being just one of the area cities jumping on the band wagon against AZ, you can be sure with a new County Council being seated in Cuyahoga County, this will soon follow at a county level. We cannot allow that to happen and must be proactive in stopping it.

Below you will find a template for a Resolution supporting the AZ Immigration Bill. We are encouraging everyone to copy & paste it for presentation to your City Council's for passage.

From Grassroots Rally Team --

On May 17, 2010 Cleveland City Council passed Resolution 675, which opposes Arizona's Senate Bill 1070 and supports Comprehensive Immigration Reform. It has been said that Columbus, Cincinnati, Dayton, Lorain and Toledo will be asked to pass similar resolutions.

The Grassroots Rally Team of Ohio has a Resolution which supports Arizona. The resolution was drafted with the help of Immigration Reform Law Institute (IRLI). We will be taking this resolution to our townships, villages and cities asking they pass this resolution to support Arizona.

This is a grassroots effort to combat the anti-Arizona resolutions that are being passed in cities. We're asking you to stand with us in supporting Arizona, by asking your community to pass this resolution.

-- Start --

Whereas, the City of (INSERT YOUR CITY), Ohio believes strongly in the integrity of the borders of the United States and that the federal government has a duty to protect these borders, including regulating the numbers and the qualifications for entrance into the country;

Whereas, the Federal Government has failed in its role to protect our borders from an unprecedented number of illegal aliens entering our country;

Whereas, the State of Arizona is in the unusual and unfortunate position of enduring the vast majority of illegal border crossings and suffering from the narcotics trafficking into our country;

Whereas, the Federation for American Immigration Reform estimates that 500,000 illegal aliens live in the State of Arizona;

Whereas, after considering both Fiscal Costs and Fiscal Revenues, it is estimated that illegal aliens cost the State over $2.7 billion annually,

Whereas, the State of Arizona, has passed Arizona Senate Bill 1070, which was amended by Arizona House Bill 2162, to assist the federal government in enforcing the nation’s immigration laws;

Whereas, the Arizona law requires its law enforcement officers to verify a person’s immigration status with the federal government, if the officer has a reasonable suspicion to believe that the person is unlawfully in the United States;

Whereas the Arizona law expressly prohibits the use of racial profiling and is designed to help enforce the nation’s immigration laws in a way that does not violate anyone’s civil rights;

Whereas the Arizona law requires aliens to register for and carry documents with them that the federal already requires such aliens to possess and does not require United States citizens to carry any documents;

Be it Resolved, that the citizens and [Your City Council] of (Your City), Ohio hereby affirm their support for the people of Arizona who must endure the direct consequences of our federal government’s failure in protecting our borders. The [xxxxx] further applauds and thanks Arizona Governor Jan Brewer and the Arizona State Legislature for protecting its citizens when the Federal Government has refused to do so.
